Earl files a lawsuit against Delta, who raises the statute of Frauds as a defense. Can Earl recover from Delta?
Delta Company hires Earl to design a Web page for Delta for $400. Before the project starts, Delta asks Earl to trouble-shoot Delta鈥檚 computer operating system software for an additional $400. Earl agrees. The entire contract is oral. Earl completes the work, but Delta refuses to pay. Earl files a lawsuit against Delta, who raises the Statute of Frauds as a defense. Can Earl recover from Delta?|||Assuming the Statute of Frauds requires all cntracts over $500 to be in writing, Earl can still win if he convinces the Court that there were really 2 $400 contracts, rather than an $800 agreement.
